No Matter how old or new your debt is, The Federal Trade Commission says debt collectors cannot harass, oppress or abuse you or any thrid parties they contact.

For Example, they cannot:

  • use threats of violence or harm
  • publish a list of names of people who refuse to pay (but they can give names to the credit reporting agencies)
  • use profanity or obscene language
  • repeatedly use the phone to annoy
  • falsely claim they are attorneys or government representatives
  • falsely claim that you have committed a crime
  • falsely claim that they work for a credit reporting company
  • misrepresent the amount you owe
  • contact you before 8am or after 9pm
  • threaten to have you arrested

If you owe money that you cannot pay, ask for proof in writing. If you dispute the debt or any portion of it, write a letter disputing the debt as soon as you are made aware of it.
